KCD2 is a critical game with every action and word resulting in a reaction. That said, Henry must always be intellectual with every move he makes to avoid getting caught in a hazardous situation. There are quite some punishments in KCD2 for all of Henry's crime. How it is given to him depends on the level of crimes committed. Since Henry will have to improvise and commit all sorts of atrocities, it is only normal that he gets punished for whatever crime committed.
Henry, being the mainstream character in the gameplay, must avoid being punished by all means. Being the mastermind of several criminal activities in KCD2, he must use several tactics to bail himself out of difficult situations after getting caught. NPCs, on the other hand, are good at tracking down unusual activities of the player characters. For example, say Henry is seen by one of these in-game characters walking into a room. A guard is called upon immediately and Henry has just four options to bail himself out of such a situation:
When push comes to shove and Henry has no choice but to accept the bailiff's punishment, the NPCs decide on what to do. There are four variants of penalties for different crimes, depending on the severity of the atrocity. Henry will also be assessed for previous wrongdoings. If guilty, any of the following punishment will be given:
This penalty is assigned for minor crimes such as pickpocketing, theft, trespassing, or home invading. Henry will be put in the stocks, where the public vividly sees and laughs at him. This punishment will affect his mission or quest and reduce his reputation. Thankfully, the effects will be short-term and people will forget and move on. Being put in the stocks will temporarily reduce Henry's charisma by 4, and conspicuousness will temporarily increase by 20. This will make it difficult for Henry to conversate with other settlers and miss out on deals.
This punishment is often assigned if Henry has committed a previous crime and is piling another one on top. He will then be stripped and caned on his back publicly. Such beatings tend to weaken Henry and affect his overall health stats, after which he will recover in full over time. Henry may also be given the punishment for middling crimes in KCD2. His strength, agility, stamina regeneration, and vitality will all reduce by 40%.
If it be that Henry committed a murder after middling several minor crimes, he will be branded with hot iron. This torture will leave him with a vivid scar. Nobody will talk to him unless his fellow criminal counterparts. Merchants will seize to do business with him, and he will be treated like an outcast until everything dies down. If branded with a hot iron, Henry's reputation will be reduced by 50%. One more crime, and it's game over!
This type of penalty falls in place when the NPCs catch Henry committing a serious crime after being branded. The bailiff will order him back to the gallows. This redirects to harrowing cutscenes and a game over. Player characters are then sent back to their recent saves.

The punishment in KCD2 is quite severe and may just be a minor one if the crime is considered mild. Henry must either be canned on his back publicly, trapped in a stock, hanged from the gallows, or tortured with hot iron. The allocation of such penalties depends on the severity of the crime. That being the case, Henry must find all possible means to survive and stay alive.
